These Terms & Conditions ("Terms") govern your access to and use of the Voltly application, website, and related services (collectively, the "Service"), provided by Loukas John Hayes, a sole trader operating in Queensland, Australia, trading as Voltly ("Voltly", "we", "us", or "our"). By creating an account, accessing, or otherwise using the Service, you agree to be bound by these Terms.
1. The Service
Voltly is a gamified learning platform for electrical trade study. It provides quizzes, flashcards, analytics, weak-point training and social features on a freemium model, with a paid "Premium" subscription unlocking additional functionality.
2. Acceptance & eligibility
By continuing to use the Service you confirm you have read, understood and accepted these Terms. You must be of legal age in your jurisdiction (or have your parent/guardian's consent) and, if signing up on behalf of a business, you confirm you have authority to bind it.
3. Accounts
- You must provide accurate information when registering and keep it up to date.
- You are responsible for keeping your credentials confidential and for all activity under your account.
- Notify us promptly if you suspect unauthorised access.
4. Acceptable use
You must not misuse the Service. In particular, you agree not to:
- Use the Service for unlawful, fraudulent, or harmful purposes;
- Infringe the intellectual property or other rights of any person;
- Interfere with the security or integrity of the Service (including malware, probing, scraping, or reverse engineering);
- Resell, redistribute, or commercially exploit the Service without our written consent;
- Share account credentials or circumvent technical or usage limits.
5. Intellectual property
Voltly and its licensors retain all right, title and interest in the Service, including all software, content, designs, trademarks and branding. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your personal, non-commercial study purposes within the plan you have subscribed to.
6. User content
You retain ownership of any content you submit to the Service. You grant Voltly a limited, worldwide, royalty-free license to host, process and display that content solely to provide and improve the Service.
7. Payments, subscriptions & billing
Premium plans are billed monthly or yearly in advance and renew automatically until cancelled. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax and cancellation mechanics are governed by Paddle's Buyer Terms and Voltly's Refund Policy. You may cancel your subscription at any time; access continues until the end of your paid period.
8. Service availability
We aim to keep the Service available, but we do not guarantee uninterrupted, timely, secure or error-free operation. We may perform maintenance, change features, or discontinue parts of the Service at any time.
9. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Voltly is a study aid; it is not a substitute for accredited training, licensed advice, or official examinations.
10. Liability
To the fullest extent permitted by law, Voltly's aggregate liability for any claim arising out of or relating to the Service is limited to the fees you have paid us in the 12 months preceding the event giving rise to the claim. We exclude liability for indirect, consequential, special or incidental damages (including loss of profits, data, or goodwill). Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or anything that cannot be excluded under applicable law.
11. Indemnity
You agree to indemnify Voltly against any claims, losses or expenses arising from your content, your misuse of the Service, or your breach of these Terms.
12. Suspension & termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay, present a security or fraud risk, or repeatedly violate our policies. You may stop using the Service at any time. On termination, your right to use the Service ends, and we may delete your account and data in accordance with our Privacy Notice.
13. Changes to the Service or Terms
We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after the effective date constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of Queensland, Australia. The courts of Queensland, Australia have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except where applicable consumer law gives you the right to bring proceedings elsewhere.
